1. Introduction

Welcome to Lola Dispatch, operated by Lola Health Ltd ("Company", "we", "our", "us"). These Terms of Service ("Terms") govern your use of the Lola Dispatch platform (loladispatch.com) and related services for phlebotomists, healthcare clients, and patients.

By using our platform, whether as a phlebotomist, healthcare client, or patient, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Platform Overview

Lola Dispatch is a marketplace that connects:

• Phlebotomists: Qualified blood collection professionals seeking work opportunities
• Healthcare Clients: Companies requiring phlebotomy services for their patients
• Patients: Individuals booking mobile phlebotomy appointments

3. Eligibility Requirements

For Phlebotomists

To register as a phlebotomist, you must:

• Be at least 18 years of age
• Hold a valid Enhanced DBS certificate
• Hold a recognised phlebotomy qualification
• Have the legal right to work in the United Kingdom
• Maintain valid professional indemnity insurance

For Healthcare Clients

To register as a client, you must:

• Be a registered healthcare provider or related business
• Provide accurate company information
• Have authority to enter into agreements on behalf of your organisation

4. Registration and Verification

Upon registration, your application will be reviewed by our team. For phlebotomists, this includes verification of your DBS certificate, phlebotomy qualifications, and identity. You will not be able to accept jobs until your account is approved.

5. Professional Conduct

All users of Lola Dispatch agree to:

• Maintain professional standards at all times
• Follow all applicable protocols and procedures
• Treat all parties with respect and dignity
• Maintain confidentiality in accordance with data protection laws
• Report any incidents or concerns promptly
• Provide accurate and truthful information

6. Job Acceptance and Cancellation

When you accept a job, you are committing to fulfil that appointment. Cancellations should only occur in exceptional circumstances and must be communicated as early as possible. Repeated cancellations may result in account suspension.

7. Payment Terms

For Phlebotomists

Payment for completed jobs will be processed according to the rates agreed at job acceptance. Payments are typically made weekly via bank transfer to your registered account. You are responsible for your own tax obligations as a self-employed contractor.

For Healthcare Clients

You agree to pay for all services booked through the platform according to the agreed rates. Payment is processed securely via Stripe. Invoices are issued according to your billing preferences.

8. Insurance and Liability

Phlebotomists must maintain valid professional indemnity insurance throughout their engagement with Lola Dispatch. You are responsible for ensuring your insurance covers the services you provide through our platform.

Lola Health Ltd acts as a marketplace facilitating connections between parties. While we verify credentials and provide the platform, each phlebotomist operates as an independent contractor responsible for their own work.

9. DBS and Background Checks

Phlebotomists' Enhanced DBS certificates must remain valid and clear. You must notify Lola Dispatch immediately of any changes to your criminal record status or any new cautions or convictions.

10. Intellectual Property

All content on Lola Dispatch, including but not limited to text, graphics, logos, and software, is the property of Lola Health Ltd or its licensors and is protected by intellectual property laws.

11. Data Protection

Your use of Lola Dispatch is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data in compliance with UK GDPR and the Data Protection Act 2018.

12. Third-Party Integrations

Lola Dispatch may integrate with third-party services (e.g., Stripe for payments, external REST APIs). Your use of these integrations is subject to the respective third-party terms of service.

13. Limitation of Liability

To the maximum extent permitted by law, Lola Health Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.

14. Termination

Either party may terminate this agreement at any time. Lola Health Ltd reserves the right to suspend or terminate your account if you breach these Terms or fail to meet our professional standards.

15. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or a prominent notice on the platform. Continued use after changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
